  • This document constitutes the Kindle Publishing Agency Digital and Print Distribution Agreement (“Agreement“) between you and Kindle Publishing Agency (a division of DIY Media Group, Inc.), referred to in this Agreement as “us,” “we,” and “Kindle Publishing Agency.”
  • This Agreement outlines the terms and conditions governing the book publishing, distribution, printing, promotional, and other services (the “Services“) provided by Kindle Publishing Agency through the Kindle Publishing Agency website (https://amazon-kindlepublishing.com/) or other affiliated websites and services operated by or on behalf of Kindle Publishing Agency and its Licensees (as defined below). By accepting this Agreement or by utilizing the Services, including the submission of materials for distribution by Kindle Publishing Agency (whether uploaded to the Website or submitted physically, such as Books or print publications), you agree to comply with the terms and conditions outlined herein and any additional terms referenced.

  • Kindle Publishing Agency retains the right to add, remove, or modify any terms and conditions in this Agreement at its discretion by posting changes on the Site. For significant changes, we will notify you via email or other suitable means. If you find any modification unacceptable, your only option is to terminate your account and cease using the Services. To terminate the distribution Agreement, log into your Kindle Publishing Agency account and cancel distribution under all applicable partners in My Books  View Status. Continued use of the Services after a change notice or new agreement will be deemed as acceptance.

  • However, modifications to this Agreement will not apply to any disputes arising between you and Kindle Publishing Agency before the modification date.

OUR SERVICES

By submitting the Order and/or payment, You are purchasing the Product for Your use only. All Products are drafted by freelance writers who transferred all rights and ownership regarding the Products to the Company. All Products are non-refundable and come with no warranties, expressed or implied. It is Your obligation to read these Terms and Conditions before submitting any Order and/or payment to this Website.

REFUND POLICY

It is important that you carefully read and understand the refund policies in order to have full knowledge of the privileges and limitations governed by the kindled publishing agency Policies. We offer refunds only in special cases and specified conditions, detailed as under:

  • You have demanded revisions beyond the initial concepts
  • The customer has not been contacted or irresponsive for more than 2 weeks without notice.
  • If the project is placed on hold upon customer request, the refund will be voided.
  • Company’s policies, or policy, have been violated.
  • The creative brief is lacking in required information from the client end.
  • The business is closing or changing its name or business.
  • Reasons such as ‘change of mind’, ‘disagreement with a partner, or other reasons that do not pertain to the service provided will not be subject to refund under any circumstances.
  • Once a client has accepted multiple sets of revisions (for any services), the refund will not be applicable.

Change of Mind:

  • The customer is entitled to 100% refund before our writers/editors start working on the project.
  • If (for any reason) you change your mind and decide against continuing your project with us after placing your order, you can ask for refund within the first hour of placing your order. A 15% processing fee will be charged in other cases.

Incompetent Delivery:

  • Once the work is delivered, customers are only entitled to claim a refund once they have exhausted all the options detailed as under;
  • If it does not comply with project requirements (as requested/documented by the customer). We are committed to provide our customers with 100% satisfaction and offer unlimited revisions to ensure that the delivery is up to the mark. We assign, re-assign and re-write your work to ensure complete satisfaction.
  • Reserve FREE Pages for future, but of same value and you can avail them at any time.
If we’re still not able to deliver what you asked for, refund will be processed with a mutual agreement on a set percentage (but only in the cases where the delivery is completely off the mark)

Late Delivery:

  • We believe in “On Time Delivery” but if, for any reason we fail to deliver the asked service on time, after at least three attempts to contact us, your refund will be processed once it is established through documentary evidence that the late delivery was the company’s fault.

Refund Time Frame:

  • Refunds must be claimed within 120 days of delivery. Refunds claimed after the set time frame will not be entertained.
  • All the customers must note the deadline for claiming refund at the time of placing order.

Cases where refund will not be issued:

  • In case of late delivery due to some minor technical errors, such as grammatical, typing, word count, missing references etc., refunds will be processed with mutual agreement and the company will only settle with partial refund or discounts reserved for future purchases.
  • The company will not be responsible for any delay from the client’s end.
  • No refund will be issued on the basis of low of writing.

Content Ownership

  • a. Kindle Publishing Agency retains all rights, titles, and interests in the content, including but not limited to texts, images, graphics, and multimedia materials provided through our services.
  • b. Users are responsible for the content they submit to Kindle Publishing Agency. By submitting content, users grant Kindle Publishing Agency a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display the content.

Use of Services

  • a. Users must comply with all applicable laws and regulations when using Kindle Publishing Agency services.
  • b. Users are prohibited from engaging in any activity that may disrupt or interfere with the proper functioning of our services, including but not limited to hacking, transmitting viruses, or spamming.

Purchases and Payments

  • a. Payment is required for the purchase of products or services offered by Kindle Publishing Agency. Prices are listed in the respective product or service description and are subject to change without notice.

  • b. Payments are processed through secure payment gateways. Kindle Publishing Agency does not store credit card details and is not liable for any security breaches on third-party payment platforms.

Copyright and Intellectual Property

  • a. Kindle Publishing Agency respects intellectual property rights. Users must not infringe upon copyrights, trademarks, or other proprietary rights when using our services.

  • b. If you believe that your intellectual property rights have been violated, please contact us with relevant details for prompt resolution.

Termination

  • Kindle Publishing Agency reserves the right to terminate or suspend access to our services for users who violate these terms and conditions.
  • The duration of this Agreement will commence upon your initial access or use of the Services or acceptance of this Agreement and will remain in effect unless terminated by either party, with a written notice period of twenty-four (24) hours (the “Term“). Kindle Publishing Agency may send termination notices to the last email address you provided, while your termination notice to Kindle Publishing Agency must be sent exclusively to https://amazon-kindlepublishing.com/, including your username, the associated email address, and “Termination of Digital and Print Distribution Agreement” in the email subject line.

  • If you wish to remove specific Book titles submitted under this Agreement, you can request removal by emailing [email protected], providing your username, associated email address, and the title(s) you want to be removed. Upon receiving your removal request, our team will initiate the removal process. However, please be aware that the titles may take 4-6 weeks or longer to be removed from retail outlets globally.

Limitation of Liability

  • a. Kindle Publishing Agency is not liable for any direct, indirect, incidental, consequential, or punitive damages arising out of the use or inability to use our services.

Governing Law

  • These terms and conditions shall be governed by and construed in accordance with the laws of [Jurisdiction], without regard to its conflict of law principles.

Modifications

  • a. Kindle Publishing Agency reserves the right to modify these terms and conditions at any time. Changes will be effective immediately upon posting on our website.
